Trial,
Appellate and Administrative Agency Litigation
Nielsen
Merksamer litigators have succeeded at every level of the court system.
Their achievements range from a landmark campaign finance decision
by the United States Supreme Court and leading
cases in the California Supreme Court and Courts of Appeal, on
the one hand, to winning federal and state court jury trials on the
other. As indicated by the list of cases that appears later in this
brochure, the firm has successfully litigated cases concerning political
issues, regulatory agency enforcement, initiatives and referenda,
voting rights and redistricting,
state taxes, government contracts, civil rights, education
law, alcoholic beverage control, state tort policy, rent
control and numerous other important matters.
Our litigators
have a thorough understanding of the operation of government agencies,
and frequently represent clients who are adversely affected by government
action and regulation, both in the courts and in contested administrative
hearings. For example, Nielsen Merksamer litigation section attorneys
represent clients before the Department of Alcoholic Beverage Control,
the Department of Education, the State Board of Education, and other
State agencies, and in federal
voting rights matters in the United States Department of Justice.
Nielsen Merksamer's
litigators have years of experience representing both private and
public sector clients, which provides a unique and important perspective
from which to address competing public policy considerations which
are at the core of most litigated disputes. We also have an established
specialty in appellate litigation
including preparing amicus curiae briefs, which often involve high
profile, important public policy disputes. Our senior litigators
are also frequently called upon to serve as mediators and arbitrators.
